Peopletail AI Voice Profile Platform Terms of Service

1. Introduction

Welcome to Peopletail’s AI Voice Profile Platform (the “Platform”), operated by Miramedia Retail Inc. (“Miramedia,” “we,” “our,” or “us”). By accessing or using the Platform, you agree to comply with and be bound by these Terms of Service (the “Terms”). If you do not agree with these Terms, please do not use the Platform.

2. Eligibility

To use the Platform, you must be at least 16 years old and capable of entering into a legally binding agreement. By using the Platform, you represent and warrant that you meet these eligibility requirements.

3. User Accounts

You may need to create an account to access certain features of the Platform. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. Miramedia reserves the right to suspend or terminate your account if any unauthorized use or breach of security is detected

4. Use of the Platform

4.1 License:

Miramedia grants you a non-exclusive, non-transferable, and revocable license to access and use the Platform for its intended purpose

4.2 Prohibited Activities:

You agree not to misuse the Platform, including but not limited to engaging in illegal activities, distributing harmful software, violating intellectual property rights, or disrupting the normal flow of communication on the Platform.

4.3 Content Ownership:

You retain ownership of any content you upload or create on the Platform. By submitting content, you grant Miramedia a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content for the operation and promotion of the Platform

5. Privacy

5.1 Data Collection:

Miramedia is committed to protecting your privacy. We collect, use, and store your data in accordance with our Privacy Policy

5.2 Data Usage:

Your personal information is used solely for the purposes of providing and improving the Platform. We do not sell your data to third parties.

5.3 User Control:

You have control over your data. You can review, modify, or delete your personal information at any time through your account settings.

5.4 Data Security:

Miramedia implements industry-standard security measures to protect your data from unauthorized access, disclosure, alteration, or destruction.

6. Intellectual Property

6.1 Ownership:

All intellectual property rights in the Platform, including but not limited to software, design, text, graphics, and trademarks, are owned by Miramedia or its licensors.

6.2 User Content:

You retain ownership of the content you create or upload on the Platform. You are responsible for ensuring that your content does not infringe on the intellectual property rights of others

7. Limitation of Liability

To the fullest extent permitted by law, Miramedia, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Platform.

8. Indemnification

You agree to indemnify and hold harmless Miramedia, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

9. Termination

Miramedia reserves the right to suspend or terminate your access to the Platform at any time, with or without notice, for conduct that it believes violates these Terms or is harmful to other users, Miramedia, or third parties.

10. Modifications to the Terms

Miramedia may modify these Terms at any time. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Platform following any changes constitutes your acceptance of the revised Terms.
